Job Posting
  1. MACLANE JR. shall place/upload/posting the information relating to vacancies in the hot vacancies and other classified/Job posting sections on its Job website/Portal www.goget.in or other online products/site(s) or other allied online products of MACLANE JR. may deem fit and proper but such additional web hosting shall be without any extra cost to the subscriber / user.

  2. The insertion/job postings will be displayed in the job posting section of Job website/Portal www.goget.in for a period of 20 days, which period is subject to change without any prior notice. Every instance of editing or refreshing and existing listing entitles you as a registered user/subscriber to an additional fixed period of 60 days, starting from the date on which the job listing/posting is edited or refreshed and shall be counted as fresh posting.

  3. The registered subscriber/user shall be assigned password (s) by MACLANE JR. to enable the subscriber/user to post/upload Job vacancies on the Job website/Portal www.goget.in in agreed upon section(s), but the sole responsibility of the safe custody of the password shall be that of the subscriber/user and MACLANE JR. or its Job website/Portal www.goget.in shall not be responsible for data loss/theft of data or corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. MACLANE JR. and its Job website/Portal www.goget.in undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the user/subscriber.

  4. The subscription or user name or password is neither re-saleable nor transferable by the subscriber/user to any other third person/party, corporate body, firm or individual, etc. Only one office of one corporate entity / firm will be entitled to use this service and in case other offices of the same company/ associated companies, want to use the said service, then, they shall have to inform MACLANE JR. or its Job website/Portal www.goget.in at contact@goget.in about the same and pay additional subscription charges if any for the service.

  5. The job posting/listing, resume database and other features of the Job website/Portal www.goget.in may be used only by individuals for seeking employment and/or career information and by employers seeking employees/candidates. Your use of the Job website/Portal www.goget.in is also subject to any other contracts you as a registered user/subscriber may have with MACLANE JR. In the case of any conflict between these Terms and any contract you have with MACLANE JR., the terms of your contract will prevail. The term “post” as used herein shall mean information that as a user/subscriber you submit/upload, publish or display on Job website/Portal www.goget.in

  6. MACLANE JR. or its Job website/Portal www.goget.in reserves the right to reject or accept any insertion or information/data provided by the subscriber/user without mentioning or giving any reason whatsoever either before uploading or after uploading the vacancy details, but in such an eventuality, any amount so paid for, may be refunded to the subscriber on a pro-rata basis at the sole discretion of MACLANE JR.

  7. By posting or uploading or placing a job vacancy on the Job website/Portal www.goget.in the user/subscriber confirms that you have obtained all licenses/permits which are necessary and authorised for recruitment or manning or body-shopping, etc. and to indemnify MACLANE JR. against all claims, damages arising out of actions/claims that may be made in relation to the same.

  8. MACLANE JR. or its Job website/Portal www.goget.in has the right to make modifications or editing of the vacancy details/Job postings in order to fit according to its database.

  9. The Subscribers or Recruiters or Employers will provide up to a maximum of 2 email ID's for vacancies posted on Job website/Portal www.goget.in in the Job Posting or Hot Jobs sections to collect/receive the response(s) if any. The contact information given by the Subscribers or Recruiters or Employers for all listing should be the same and the Subscribers or Recruiters or Employers cannot give multiple contact information/data for the purpose of Job listing or uploading or placing.

  10. All information intimated by the Subscribers or Recruiters or Employers are displayed or uploaded by MACLANE JR. on its Job website/Portal www.goget.inbecomes public knowledge and MACLANE JR. may at its sole discretion include the vacancy intimated by a Subscribers or Recruiters or Employers for display on its Job website/Portal www.goget.in or any other online product or media including the print media at no extra costs to the Subscribers or Recruiters or Employers and MACLANE JR. shall not be held liable for usage/publicity of such information.

  11. We as a company neither offer guarantee nor warranties that there would be a satisfactory response or feedback or any at all response once the job posting is put on display.

  12. MACLANE JR. or its Job website/Portal shall in no way be held liable for any information received by the Subscribers or Recruiters or Employers and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.

  13. MACLANE JR. or its Job website/Portal www.goget.in would not be held liable for any loss of data or information, technical or otherwise, information, particulars supplied by the user/subscriber, due the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond MACLANE JRs control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities, etc.

  14. MACLANE JR. will commence providing services only upon receipt of amount/charges /fee upfront either from the user/subscriber or from a third party on behalf of the subscriber/user.

  15. The subscriber/Recruiter/User/Employers shall be deemed to give an undertaking to MACLANE JR. that the jobs sought to be advertised on the Job posting sections of Job website/Portal www.goget.in are in existence, are genuine and that the subscriber/Recruiter/User/ Employers has the authority to advertise for such jobs.

  16. The subscriber/Recruiter/User/Employers must give an undertaking to MACLANE JR. that there will be no fee/cost charged from any person who responds to jobs advertised on the Job Posting sections of Job website/Portal www.goget.in for processing of applications / responses from such person.

  17. MACLANE JR. reserves its right to change the look, feel, design, prominence, depiction, classification, etc. of the Job posting sections of the Job website/Portal www.goget.in any time without assigning/giving/providing any reasons whatsoever and without giving any notice.

  18. The subscriber/user shall be assigned password (s) by MACLANE JR. to enable the user/subscriber to post job vacancies on the site in agreed upon section(s), but the sole responsibility of the safe custody of the password shall be that of the user and MACLANE JR. shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. MACLANE JR. undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.

  19. The user/subscriber of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the Job website/Portal www.goget.in.

  20. The subscriber/user to this service shall be entitled to such number of listings during the period of subscription as may be agreed upon.

  21. Job Postings/Listings should contain with contact information registered with MACLANE JR. and will be displayed on the Job website/Portal www.goget.in.

  22. All disputes arising out of the transactions between a user/subscriber and MACLANE JR. will be resolved in accordance with the laws of India as applicable.

  23. All Disputes arising out of the transactions between a user and MACLANE JR. will be subject to the jurisdiction of Courts situate in Mumbai alone.

  24. MACLANE JR. and its Job website/Portal www.goget.in, reserves the right to remove any job posting/listings or content from Job website/Portal www.goget.in or in any affiliated online products of MACLANE JR., which in the reasonable exercise of MACLANE JRs discretion, does not comply with the above terms and conditions, or if any content is posted/listed with Job website/Portal www.goget.in is not in the best interest of MACLANE JR. or any of its affiliated online products.

  25. If at any time during the use of our Services, the user/subscriber made a misrepresentation of fact to Job website/Portal www.goget.in or otherwise misled MACLANE JR. or its Job website/Portal www.goget.in in regards to the nature of your business activities, MACLANE JR. (www.goget.in) will have grounds to terminate your use of Services.

 
Fee or Payment
  1. The Subscribers/User or Recruiters or Employers shall pay the Subscription Fees or payment as per the rate applicable for the Services provided as mentioned in the Product Catalogue or as may be prescribed by the Company from time to time for Job Postings, Ad, Database accessibility, SMS, Chatting, Video Conferencing and or any other facility etc.

  2. Liability for payment of the Subscription Fees and other fee shall accrue from the Date of Commencement.

  3. When Subscription Fee or payment accrues it shall be paid/ payable at or within such time as stated in the invoice(s) raised by the Company on the User/Subscriber.

  4. The Subscription Fees or payment shall be paid by the User/Subscriber on demand by online or offline. In case the user/subscriber disputes the same for any reason whatsoever, the user/subscriber shall make the fee or payment towards the Subscription Fees accrued subject to the decision of MACLANE JR. on the dispute. In the event of MACLANE JR. deciding the dispute in User's/Subscriber’s favour, the Company shall refund to the User/Subscriber any excess amount paid by the User/Subscriber without any interest.

  5. In case of any delay in the payment by the User/Subscriber of any sums due under this Agreement, MACLANE JR. shall have the right to charge interest on the outstanding amount from the date the payment became due up to the date of final payment by the User at the rate of 18 % p.a.

  6. All users/subscribers/Job seekers who accessing job search or ad or resume or information at Job website/Portal www.goget.in for the purpose of seeking employment shall be exempted from the application of this clause (if applicable).

 
Usage of Contents
  1. The user/subscriber undertakes to use Job website/Portal www.goget.in for her/his own purposes. Using content from Job website/Portal www.goget.in for derivative works with a commercial motive without prior written consent from MACLANE JR. is strictly prohibited and uncalled for and illegal.

  2. MACLANE JR. authorizes the user/subscriber, to view and use the content available on the Job website/Portal www.goget.in or from MACLANE JRs affiliated online products and to access and use the Job website and the contents in it and to download and print a copy of the contents available on or from Job website/Portal www.goget.in or MACLANE JRs affiliated online products solely for the personal use of the user/subscriber and for non-commercial use and purpose. The contents of the Job website/Portal www.goget.in, and of all other websites under MACLANE JRs banner/ control, whether partial or otherwise, that is designs, text, graphics, images, video, information, logos, button icons, software, audio files, chat software/technology, SMS Technology, etc. and other contents are protected under copyright, trademark and other laws. Unauthorized and illegal use of the Job website/Portal www.goget.in contents may violate these laws and/or applicable communications regulations and statutes, and is strictly prohibited. You may not download or use or sell or modify the contents of Job website/Portal www.goget.in or reproduce, display, publicly perform, distribute, or otherwise use in any way for any public or commercial purpose, in connection with products or services that are not those of MACLANE JR., in any other manner that is likely to cause confusion among users or subscribers or consumers or that otherwise infringes intellectual property rights of MACLANE JR.

  3. At any given point of time you are not allowed or authorised to use any of the contents from the Job website/Portal www.goget.in on any other affiliated online products of MACLANE JR.

 
Termination, Liabilities upon termination and Suspension of Service

MACLANE JR. may terminate this Agreement with immediate effect, without prior notice and without assigning any reason/s whatsoever and without any prejudice to any/all other rights in the following events:

  1. On completion of the term for which the user/subscriber engages the services of the Company.

  2. If in the opinion of the Company, the user/subscriber has breached any of the terms and conditions of this agreement and/or the order form signed by him.

  3. If, in the opinion of the Company or/and any regulatory authority, it is not in the public interest to continue providing the Service to the user/subscriber for any reason and /or.

  4. If the user/subscriber is declared a bankrupt or/and the user/subscriber enters into any compromise or arrangement with its creditors.

  5. On writing and on such terms as agreed to by the parties mutually in writing.

  6. The amounts due and payable to the Company by the user/subscriber upon termination shall be paid within 15 days of the relevant Date of Termination.

  7. If any money’s payable by the user/subscriber to the Company is not paid on the due date, the Company may without prejudice to any other rights or remedies that may be available to it suspend the Service provided to the user/subscriber.

  8. When the service subscribed for is suspended for any reason whatsoever the user/subscriber shall continue to be liable for all charges and fee notwithstanding such suspension.

  9. Upon subsequent payment by the user/subscriber of such money’s as demanded by the Company, the Company may at its discretion and subject to such terms as it deems proper, reconnect the service

 
Obligation of User/Subscriber
  1. The accuracy and authenticity of the Registration Data given to the Company on initial application form for the Service shall be the sole responsibility of the user/subscriber.

  2. The user/subscriber confirms that he/she has obtained all licences and permits which are necessary for posting and uploading a job listing on the company's Job website/Portal www.goget.in. The user/subscriber indemnifies and agrees to keep the company indemnified against all demands, claims and damages which may arise out of the said job posting/listing.

  3. Any licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the Service shall be obtained by the user/subscriber at their own cost.

  4. The user/subscriber will ensure compliance with all notices or instructions given by the Company from time to time to enable the use of the Service.

  5. The user/subscriber understands and agrees that user/subscriber is responsible for the payment of all applicable taxes and for all costs that are incurred in using the Job website/Portal www.goget.in service.

  6. The user/subscriber shall be solely responsible for all information retrieved, stored and transmitted through the Service.

  7. The user/subscriber understands and agrees that they shall at all times comply with the requirements of Information Technology Act 2000 as well as all rules, regulations, guidelines, bye laws and notifications made there-under.

  8. The user/subscriber hereby expressly agrees that the Company has performed and complied with the requirements of Information Technology Act 2000 as well as all rules, regulations, guidelines, bye laws and notifications made there-under.

  9. The user/subscriber shall keep confidential and not disclose to any person the user/subscriber's password and user/subscriber identification and all activities and transmission performed by the user/subscriber through his/her user identification.

  10. The user/subscriber shall immediately notify the Company of any un-authorized use of the user/subscriber's account or any other breach of security known to the user/subscriber.

  11. The user/subscriber shall promptly make the payment to the Company towards the Subscription Fees or any features, availed as and when it becomes payable.

  12. The user/subscriber shall be responsible for the set-up or configuration of his/her computer and other equipment for accessing any Service.

  13. For SMS services, users/subscriber’s mobile phone number will be used during the transmission of text messages through the mobile service provider's server.

  14. User/Subscriber agrees that SMS or its contents once sent for availing SMS services shall be treated as final and the same cannot be withdrawn, changed or retrieved subsequently under any circumstances.

  15. SMS service is subject to guidelines/directions issued by Telecom Regulatory Authority of India or any other statutory authority from time to time.

  16. By using various SMS based services, user/subscriber agrees to receive phone calls, messages etc. from MACLANE JR. and/or its Job website/Portal www.goget.in and/or its associates tailored to provide with better job opportunities.

  17. The user/subscriber agrees to allow the Job website/Portal www.goget.in and employers/recruiters registered online or associated with it to get in touch with him/her from time to time on events, offers, information and promotions regarding jobs and ancillary services through landline, mobile or any other means.

  18. The user/subscriber agrees that in the event he/she does not want recruiters / employers to send SMS alerts, he/she can opt out of the facility by changing his settings in edit personal profile section.

  19. The Job website/Portal www.goget.in in its sole discretion shall reserve the right to edit, modify and alter the content. User/Subscriber agrees that such content placed with Job website/Portal www.goget.in shall be reflected between 24-48 hours. The user/subscriber further agrees to the stipulated time frame of 24-48 hours processing

  20. 20. The user/subscriber will indemnify Company for any action or claim committed/made by any third party resulting from any information posted on the site by the user or/and anybody else on his/her behalf.

 
Restricted Actions on Job website/Portal www.goget.in
  1. The user/subscriber is restrained from allowing any person or third party other than the authorised person(s) named in the Order form to use the Service of Job website/Portal www.goget.in

  2. The user/subscriber undertakes not to re-sell or assign his/her rights or obligations under this Terms & Conditions. User/Subscriber also agrees not to make any unauthorized commercial use of the Service.

  3. The user/subscriber shall use the Service only for the purpose for which it is subscribed.

  4. The user/subscriber shall comply with all applicable laws (and shall not contravene any applicable law) of India relating to the Services, including any regulation made pursuant thereto.

  5. The user/subscriber shall not print, download, duplicate or otherwise copy, delete, vary or amend or use any data or personal information posted by any user/subscriber on Job website/Portal www.goget.in except such data and information which are posted by the particular user/subscriber.

  6. The user/subscriber shall not share the Service with any person or third party without the prior written approval of the Company.

  7. The user/subscriber shall not use the Service for any unlawful purpose including without limitation criminal purposes.

  8. The Service shall not be used to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an abusive, indecent, obscene, defamatory or menacing nature.

  9. The user/subscriber shall be prohibited in persistently sending messages or make postings on Job website/Portal www.goget.in to any other user/subscriber or third party who access Job website/Portal www.goget.in without reasonable cause or for causing any threat or/and harassment or/and annoyance or/and anxiety or/and any other inconvenience whatsoever caused to any person.

  10. The user/subscriber shall not infringe on any intellectual property rights of any person or/and retain information in any computer system or otherwise with an intention to do so.

  11. The user/subscriber shall give out to the company a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or user data displayed in your listings. For the purpose of this Agreement, "User Data" shall mean all information (if any) submitted by the user/subscriber to Job website/Portal www.goget.in with the exception of trading data, credit card numbers, checking account numbers, etc. "Individually Identifiable User Data" shall mean that subset of "User Data" which can be reasonably used to identify a specific individual such as their name, address, phone number, etc. The User Data shall be deemed to be the property of the Job website/Portal www.goget.in (MACLANE JR.). The user/subscriber shall take all reasonable efforts to ensure that it is accurate and complete and not misleading in any way.

  12. The user/subscriber agrees not make use of anyone else's information/data other than as necessary to complete any www.goget.in (MACLANE JR.) transactions in which he/she is involved.

  13. The user/subscriber shall not violate, or attempt to violate the security of the Job website/Portal www.goget.in and/or any web sites or online products affiliated to MACLANE JR. or gain un-authorized access any information regarded as private by other users/subscribers or persons, including but without limitation to accessing data and information not intended for them or logging onto a server or account which the user/subscriber is not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication.

  14. The user/subscriber shall be prohibited to host, display, upload, modify, publish, transmit, update or share any information on the Job website/Portal www.goget.in, like:

    1. belongs to another person and to which you do not have any right to;

    2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

    3. harm minors in any way;

    4. infringes any patent, trademark, copyright or other proprietary rights;

    5. violates any law for the time being in force;

    6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

    7. impersonate another person;

    8. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

    9. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

    10. Any material uploaded by the user/subscriber shall be subject to relevant laws and may disabled, or and may be subject to investigation under appropriate laws. Furthermore, if the user/subscriber found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Job website/Portal www.goget.in, we may terminate your user account/block your access to the Job website/Portal www.goget.in and we reserve the right to remove any non-compliant material uploaded by the user/subscriber.

  15. In the event that the user/subscriber breaches any of the above mentioned covenants, the company MACLANE JR. shall have the right to delete any material relating to the violations without prior notice to the user/subscriber. The Company shall issue a warning to the user /subscriber to discontinue any activity which leads to the said violations and in the event the user/subscriber continues with such prohibited activity, the Company reserves the unilateral right to suspend or/and deactivate the user's/subscribers access to the Job website/Portal www.goget.in the Service and/or any other related facility and to forfeit any amounts paid by the user/subscriber. In addition to the right to indemnity available to the Company, the Company shall have the right to any legal remedy, against the user/subscriber to recover the loss suffered by the Company and the harm caused to the reputation of the Company, due to such violation by the user/subscriber.

  16. The user/subscriber shall avail of the Job website/Portal www.goget.in or any other online products related to MACLANE JR. for lawful purposes alone. Transmission or/and distribution or/and storage of material or/and conduct in violation of any applicable local or/and state or/and Central or/and foreign law or/and regulation is prohibited. This includes without limitation any unauthorized use of material protected by patent or/and copyright or/and trademark or/and other intellectual property right, material that is obscene or/and defamatory or/and libelous or/and constitutes an illegal threat, or/and violates rights of privacy or publicity, or/and violates export control laws. The user/subscriber may use the information on our Job

  17. The user/subscriber is hereby prohibited from charging any fee from the candidates whose data/information is available on the Job website/Portal www.goget.in or processing job application of such person.

  18. The user/subscriber/third parties is/are hereby prohibited from making any claim, false representation/assertions on behalf of MACLANE JR. or its Job website/Portal www.goget.in or its affiliated online products.

  19. MACLANE JR. (www.goget.in) strongly opposes and objects SPAM, which floods the Internet with unwanted and unsolicited email and deteriorates the performance and availability of the Job website/Portal www.goget.in service. All forms of SPAM, or any other activities that have the effect of facilitating SPAM, are strictly prohibited.

  20. MACLANE JR. (www.goget.in) also prohibits the use of another Internet service to send or post SPAM to drive visitors to your site hosted on or through the Job website/Portal www.goget.in systems, whether or not the messages were originated by you, under your direction, or by or under the direction of a related or unrelated third party.

Use of www.goget.in Database (Resume) by User’s/Subscribers
  1. 1. The user/subscriber shall utilize the Database (Resume) as provided in these terms and conditions or in any form of contract the user/subscriber have with MACLANE JR. ie the Job website/Portal www.goget.in. The user/subscriber shall use the Database (Resume) in accordance with all applicable privacy and data protection laws, and the user/subscriber agrees that the user/subscriber shall not further disclose any of the data (Resume) from its Database to any third party or individual or company, unless the user/subscriber are an authorized Recruitment/Placement Agency, Staffing Agency, Consultants, Manning Agency, Advertising or HR Agency or any other Agency or using the Database (Resume) exclusively for employment purposes.

  2. The user/subscriber shall take appropriate physical, technical, and administrative measures to protect the Data (Resume), the user/subscriber have obtained from the Job website/Portal www.goget.in Database (Resume) from loss, misuse, unauthorized access, disclosure, alteration or destruction, etc. The User/Subscriber shall not share Database (Resume) login and password or any other credentials with any other third party or individual.

Terms applicable to Job Seekers/Candidates.
  1. 1. When a user ie Job Seeker/Candidate register with Job website/Portal www.goget.in, the user ie Job Seeker/Candidate will be asked to create an account and provide the Job website/Portal www.goget.in (MACLANE JR.) with certain information including, without limitation, a valid email address (User "Information").

  2. Any profile/resume/curriculum vitae the user ie Job Seeker/Candidate submits/upload must be accurate and describe the user ie Job Seeker/Candidate, as an individual person. The profile/resume/curriculum requires standard fields to be completed and the user ie Job Seeker/Candidate may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting the user, other than user’s ie Job Seeker/Candidate last name and URLs.

  3. The user ie Job Seeker/Candidate acknowledge and agree that the user ie Job Seeker/Candidate is solely responsible for the form, content and accuracy of any profile/resume or material contained therein placed by the user ie Job Seeker/Candidate on www.goget.in.

  4. MACLANE JR. (www.goget.in) reserves the right to offer third party services and products to you based on the preferences that as a user you identify in your registration form and at any time thereafter or you as a user have agreed to receive, such offers may be made by MACLANE JR. (www.goget.in) or by third parties. Please see www.goget.in Privacy Statement and Policy, for further details regarding the user Information.

  5. As a jobseeker/candidate you understand and acknowledge that you have no ownership rights in your www.goget.in account and as a user that if you cancel your account in Job website/Portal www.goget.in or your account is terminated, all your user account information from Job website/Portal www.goget.in, including resumes, Profiles, cover letters, photos, educational certificate copy, experience certificates copy, saved jobs, questionnaires, etc. will be marked as deleted in and may be deleted from the Job website/Portal www.goget.in databases and will be removed from any public or viewable area of the Job website/Portal www.goget.in. Information may continue to be available for some period of time because of delays in propagating such deletion through the servers. In addition, third parties may retain saved copies of your Information.

MACLANE JR. (www.goget.in) reserves the right to delete your user account and all the information’s of yours after a significant duration of inactivity.

User/Subscriber acceptance of Terms of Use of VIDEO SERVICE
  1. By accessing or using this Job website/Portal www.goget.in Video Service as a user/subscriber, as a user/subscriber, you agree to be bound by these Terms of Use, the said Terms of Use and Privacy Statement and Policy, or any amendments thereof, applicable laws, rules and regulations governing this Job website/Portal www.goget.in.

By using MACLANE JRs Job website/Portal www.goget.in, you as a user/subscriber expressly relieve and absolve MACLANE JR. and its Job website/Portal www.goget.in from any and all the liability arising from your use of any third-party website. MACLANE JR. and its Job website/Portal www.goget.in also reserve the right to decide the inclusion or non-inclusion of any video content/footage in it without giving any reason of its non-inclusion. Also MACLANE JR. and its Job website/Portal www.goget.in reserve the right to withdraw any video content/footage at any time without recourse to or permission of the contributor or provider.

  5. MACLANE JR’s Job website/Portal www.goget.in Video Service feature is particularly and only allows or permits to its registered users/subscriber who have a valid login ID and password to upload video content/footage related to the Jobseekers/candidates resumes, profile, covering letter, brief, etc. and allows to Employers’/Recruiters to upload company profile, Job posting, and contents ancillary and incidental thereto to be hosted by Job website/Portal www.goget.in and to be configured by applicable Technology used in the Job website/Portal www.goget.in for public display/view on www.goget.in or the affiliated online products of MACLANE JR. website network, including but not limited to MACLANE JR. website network and on MACLANE JR. website affiliates and syndicated third party sites, and for the public posting, viewing and sharing of the Video Content/footage. As a user/subscriber you sincerely and wishfully and wilfully agrees and acknowledge that the Job website/Portal www.goget.in Video Service is a not a private service and it is hereby clarified that once the registered users of Job website/Portal www.goget.in and MACLANE JR. website network submits their respective Video Contents/footage for inclusion into the Job website/Portal www.goget.in, and it will be accessible by the public at large, and that there is no confidentiality or privacy with respect to the Video Content/footage uploaded. Further, registered users of Job website www.goget.in also agrees and acknowledges that their Video Content/footage submitted to www.goget.in and MACLANE JR. website network Video Service may, in Job website/Portal www.goget.in or MACLANE JR. website network's discretion, appear on local websites in other countries.

  6. MACLANE JR’s Job website/Portal www.goget.in may permit you as a user/subscriber to use its Video Service/footage. However, this services as set forth in this Terms of Service, provided that: (i) as a registered user/subscriber of Job website/Portal www.goget.in, your use of the these services as permitted is solely for your use (ii) as a registered user/subscriber of Job website/Portal www.goget.in, as a user/subscriber you will not copy or distribute any part of the product and services in any medium without the prior written permission from MACLANE JR. and/or Job website/portal www.goget.in; (iii) as a registered user/subscriber of Job website/Portal www.goget.in, you as a registered user/subscriber, will not adulterate, manipulate, change, alter, amend or modify any part of the Video content/footage contained in Job website/Portal www.goget.in and as a registered user/subscriber of the Job website/Portal www.goget.in, you comply with the terms and conditions of these Terms of Service as well as Terms of Use and Privacy Statement and policy mentioned and specified on the Job website/Portal www.goget.in While registering yourself on Job website/Portal www.goget.in, as a registered user/subscriber of Job website/Portal www.goget.in, you shall submit your accurate, transparent, sincere and complete details and information/data and must keep your login ID and password secure to prevent misuse and unauthorized use of your login ID or account. In the event of any breach of security or unauthorized or illegal use of your login ID / Account you must notify MACLANE JR. (www.goget.in) immediately. MACLANE JR. (www.goget.in) will not be liable for any loss caused by any unauthorized use of your login ID / Account. As a registered user/subscriber of Job website/Portal www.goget.in, you may be liable for the losses of MACLANE JR. (www.goget.in) due to such unauthorized and illegal use. As a registered user/subscriber of Job website/Portal www.goget.in, you also agrees not to use any automated system including but not limited to the use of "robots," "spiders," "offline readers," etc., that accesses the Job website/Portal www.goget.in in a manner that sends multiple request messages to the Job website/Portal www.goget.in web servers in a given period of time than a normal prudent person can reasonably produce in the same period by using a convention on-line web browser. As a registered user/subscriber of Job website/Portal www.goget.in, MACLANE JR. permits its registered users/subscriber of Job website/Portal www.goget.in the submission of videos/footage or other communications in Job website/Portal www.goget.in and the registered user/subscriber agrees and allows MACLANE JR. (www.goget.in) the hosting, sharing, and/or publishing of such submissions. MACLANE JR. ie www.goget.in does not guarantee any secrecy and confidentiality with respect to any of the Video or other communication submissions in Job website/Portal www.goget.in The concerned registered users/subscribers of Job website/Portal www.goget.in are solely responsible for their video content/footage submissions and the consequences of posting or publishing them on Job website/Portal www.goget.in. In this regard the concerned registered users/subscriber of Job website/Portal www.goget.in affirm, represent, and/or warrant that they have the necessary licenses, rights, consents, and permissions to use and authorize MACLANE JR. ie www.goget.in to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Video content/footage to enable inclusion and use of the Video Content/footage in the manner contemplated by Job website/Portal www.goget.in Privacy Statement and Policy and Terms of use; and also have the necessary required written consent, release, and/or permission contemplated by Job website/Portal www.goget.in

  8. The concerned registered users/subscribers, jobseekers, recruiters, employers and other contributor of Video Content/footage on Job website/Portal www.goget.in hereby agree not to include any Video Content/footage that in any manner whatsoever is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, pornographic, offensive, indecent, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, etc. or otherwise objectionable.

  9. The registered users/Subscriber and other providers or contributors of Video Content or Video footage, in Job website/Portal www.goget.in hereby grant MACLANE JR. ie Job website/Portal www.goget.in a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the submitted video content or video footage in connection with the Job website/Portal www.goget.in and its affiliate online products business of MACLANE JR., including without limitation for promoting www.goget.in (Job website/Portal) in any manner whatsoever. The concerned registered users/subscribers or account holders and other contributor or providers of Video Contents or video footage in www.goget.in (Job website) also hereby grant MACLANE JR. ie Job website www.goget.in a non-exclusive license to access their video contents or video footage through www.goget.in (Job website), and to use, reproduce, distribute, prepare derivative works of, display and perform such Video contents/Footage through Job website/Portal www.goget.in and under these Terms of Use. The aforesaid license and permission granted by you as a user/subscriber to Job website/portal www.goget.in (MACLANE JR.) terminates once the concerned registered users/subscriber and other contributor of Video Content/Footage in Job website www.goget.in remove or delete their Video Contents/Footage from Job website/Portal www.goget.in

  10. The concerned registered users/subscriber and other contributors or providers of Video Content/footage in Job website/Portal www.goget.in also further agree that they shall not submit any content/footage that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless they are the actual or real owner of such rights or have permission from their rightful owner to post the content/footage and to grant MACLANE JR. ie Job website/Portal www.goget.in all of the license or rights granted thereto and they also not publish false or fake or fabricated contents/footage or material that may damage MACLANE JR. ie Job website/Portal www.goget.in or any third party and also hereby agree not to submit/upload any material, information, data, etc. that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, religious, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; post advertisements or solicitations of business, impersonate any third party.

The genuineness, accuracy or otherwise endorse any Video content/footage or any opinion, recommendation, or advice expressed therein, and MACLANE JR. ie Job website/Portal www.goget.in hereby expressly disclaims any and all liability with respect to the video content/footage inclusions in Job website/Portal www.goget.in and as a company we do not verify the authenticity of the contents/footage. MACLANE JR. ie Job website/Portal www.goget.in does not permit copyright infringing activities and infringement of intellectual property rights on Job website/Portal www.goget.in, and MACLANE JR. reserves the right of deletion or removal of any video content/footage without prior notice if it comes to our knowledge or if it is notified that such video content/footage infringes and/or violates any third party’s Trade Mark, Copy right and / or any other intellectual property right and as a company we may also terminate access to its Job website/Portal www.goget.in or even the affiliated online products of MACLANE JR. As a company MACLANE JR. ie Job website/Portal www.goget.in also reserves the right to decide whether a particular video content/footage or material or data or information is appropriate and complies with the Terms of use and Privacy Commitment of Job website/Portal www.goget.in and these Terms of Use for violations other than copyright infringement and violations of intellectual property law including but not limited to, pornography, obscene or defamatory material, or excessive length. As a company MACLANE JR. shall delete or remove such Video Content/footage and/or terminate such violator's access to Job website/Portal www.goget.in at any time, without any prior notice at its sole discretion for uploading such video content/footage in violation of Terms of use and Privacy Commitment of Job website/Portal www.goget.in as well as the Terms of Use. Concerned registered users/subscribers, jobseekers, recruiters, employers, etc. and other contributors or providers of Video Content/footage in Job website/Portal www.goget.in hereby agree and acknowledge that they may be liable if their video content/footage submissions in Job website/Portal www.goget.in are not genuine, inaccurate, offensive, indecent, or objectionable, and they also agree to waive, and hereby do waive, any legal or equitable rights or remedies they have or may have against MACLANE JR. with respect thereto, and agree to indemnify and hold MACLANE JR. ie www.goget.in, its affiliates and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to their video content/footage submission/uploading in Job website/Portal www.goget.in

  12. As a Company, MACLANE JR. ie Job website/Portal www.goget.in reserves the right to sell, license and/or display any advertising, promotional and distribution rights in connection with the Video Content/footage and other material submitted in Job website/Portal www.goget.in and we will be entitled to retain any and all revenue generated from any sales or licenses of such advertising, promotional or distribution rights. Nothing in these Terms of Use obligates or may be deemed to obligate MACLANE JR. ie www.goget.in to sell, license or offer to sell or license any advertising, promotion or distribution rights.

  13. As a company, MACLANE JR. has the rights and protected the video content/footage, material and software on its Job website/Portal www.goget.in and MACLANE JR. is the owner and the property of Job website/Portal www.goget.in and protected by all the local and international applicable laws including but not limited to laws related to Trade Mark, Copyright and other intellectual property rights. You as a registered user/subscriber agree that you will not copy, modify, alter, reproduce, create derivative works, or display to the general public any of the Job website/Portal www.goget.in video content/footage from the Job website/Portal. As a registered user/subscriber, you also agree that you will not in any manner whatsoever including by the use of any automated device or manual process monitor or copy any of the video content/footage from the Job website/Portal www.goget.in If any use of the Job website/Portal www.goget.in video service that infringes or violates the Terms of Use and/or Privacy Commitment and/or Trade Mark, Copyright and intellectual property rights of MACLANE JR. ie Job website/Portal www.goget.in will be treated as a serious and unlawful infringement and violation and investigated accordingly. MACLANE JR. ie the Job website/Portal www.goget.in shall have the right to take appropriate civil and / or criminal action for such infringement and / or violations.

  14. As a user/subscriber or content provider/ contributor, you hereby waive all claims against MACLANE JR. or its Job website/Portal www.goget.in and indemnify its owners, directors, employees, authorized representatives and agents from any and all liability for claims, damages (actual and/or consequential), costs and expenses including but not limited to litigation costs and attorneys' fees of every kind and nature, arising out of or in any way whatsoever concerned with use of the MACLANE JR. and its Job website/Portal www.goget.in video Service and also arising out of your violation of any term of these Terms of Use; your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim of video content submission causing damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Job website/Portal www.goget.in

As a user/subscriber or content provider/ contributor, you agree and acknowledge that your use and access of Job website/Portal www.goget.in and its video service shall be at your sole risk, responsibility and consequences. To the fullest extent permitted by law, MACLANE JR. or its Job website/Portal www.goget.in, its owners, officers, directors, employees, authorised representatives and agents disclaim all warranties, express or implied, in connection with the Job website/Portal www.goget.in video service and your use thereof. MACLANE JR. or its Job website/Portal www.goget.in makes no warranties or representations about the accuracy or completeness of Job website's contents or the contents of any affiliated online products/sites linked to Job website/Portal www.goget.in and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Job website/Portal www.goget.in video service and the Job website/Portal www.goget.in (iii) any unauthorized access to or use of its servers and/or any and all personal information and/or financial information stored therein in any form and/or in any manner, (iv) any interruption or cessation of transmission to or from Job website/Portal www.goget.in (iv) any bugs, viruses, trojan horses, or the like unauthorised tools or software which may be transmitted to or through the Job website/Portal www.goget.inby any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Job website/Portal www.goget.inMACLANE JR. or its Job website/Portal www.goget.indoes not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Job website/Portal www.goget.inor any associated or hyperlinked website and MACLANE JR. shall not be a party to or in any way be responsible or accountable for monitoring any transaction between you and third-party.

  16. The concerned registered users, jobseekers and other contributors or providers of video content/footage in Job website/Portal www.goget.inhereby agree and acknowledge that MACLANE JR. or its Job website/Portal www.goget.inshall not be liable for their video content/footage submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with them.

  17. In no event shall MACLANE JR. or its Job website/Portal www.goget.inits Owners, officers, directors, representatives, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any

    1. errors, mistakes, or inaccuracies of the video content/footage

    2. personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Job website/Portal www.goget.in

    3. any unauthorized access to or use of MACLANE JR. or its Job website/Portal www.goget.insecured servers and/or any and all video content/footage and/or personal information and/or financial information stored therein

    4. any interruption or cessation of transmission to or from Job website/Portal www.goget.in

    5. any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Job website/Portal www.goget.in by any third party, and/or

    6. any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content submitted, posted, emailed, transmitted, or otherwise made available via the Job website/Portal www.goget.in, whether based on warranty, contract, tort, or any other legal arrangement, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable local and/or international jurisdiction

MACLANE JR. and its Job website/Portal www.goget.inshall have the right to amend, vary or modify the Terms of Use, Privacy Commitment of Job website/Portal www.goget.inand these Terms of Use governing this video service at any time, without giving any prior notice to anybody and such amendment shall be effective immediately upon inclusion / posting of such amendment on the Job website/Portal www.goget.in.

These “Terms of Use” and “Privacy Commitment” of Job website constitute a binding agreement between you as a registered user/subscriber and MACLANE JR. and its Job website www.goget.in, and is accepted by You upon your use of the Job website/Portal www.goget.in

 
SMS Service
  1. SMS packs once bought from Job website/Portal www.goget.inwill have minimum validity for a period of 45 days but cannot be refunded or exchanged for any other affiliated online products of MACLANE JR.

  2. Over and above the Job website/Portal www.goget.in, SMS packs will not be clubbed with any other online products of MACLANE JR.

  3. SMS facility can be used only as long as Recruiter/Employer/Job Provider has a live subscription to the Database (Resume) of Job website/Portal www.goget.in. In case subscription to Database has expired then Recruiter/Employer/Job Provider will not be able to send SMS until the subscription is renewed for a further period of time even if the Recruiter/Employer/Job Provider has balance SMSs in their account.

  4. The available or balance SMSs (not used from the previous buy) will remain with the Recruiter/Employer/Job Provider and the same can be used once the Recruiter/Employer/Job Provider renews the Subscription.

  5. Recruiter/Employer/Job Provider can SMS only those candidates on that search page that show up post conducting search.

  6. Any amount of SMSs can be purchased in one time and thereafter.

  7. Recruiter/Employer/Job Provider at all times should try and ensure that SMSs are being sent to only relevant candidates/job seekers to get maximum response.

  8. MACLANE JR. ie Job website/Portal www.goget.in reserves the right to scan all content being sent out on SMSs and block SMSs if necessary if content of the SMS is deemed as spam or any non-recruitment content or whatsoever.

  9. MACLANE JR. ie Job website/Portal www.goget.inthe right to regulate number of SMSs sent out to a particular profile on a particular day (this is to safeguard consumer interests in case consumer is getting spammed by some recruiter)

  10. MACLANE JR. ie Job website/Portal www.goget.in will try its utmost and deliver all SMS sent out, it does not take any responsibility for SMSs not delivered (which may be on account of phones being out of order, operator network problems, sim card may not being used anymore or the reason can be anything). It does take the responsibility of the SMSs leaving its vendor SMS gateway.

  11. MACLANE JR. ie Job website/Portal www.goget.inthe right to change, withdraw, terminate the scope and scale of service at any point of time, without any reason whatsoever.

  12. SMSs being sent out after 7 in the night will cue up in the MACLANE JRs ie the Job website/Portal www.goget.in system and will be delivered to the candidates after 8.00am in the morning (this is in keeping with telecom regulations)

  13. In India only the service is available across all operators.

  14. VAS rates as levied by their respective operator would be applicable for candidates who will reply to these SMSs. For further details please contact your respective mobile operator.
